Understanding Power of Attorney Types

Not sure which type you need? Here's a plain-English explanation of the most common types of Power of Attorney.

Durable Power of Attorney

A "durable" Power of Attorney stays in effect even if you become mentally incapacitated. This is the most common type and the one most people need. Without the "durable" designation, a standard Power of Attorney becomes invalid the moment you can't make decisions yourself — which is often exactly when you need it most.

Medical / Healthcare Power of Attorney

This authorizes someone to make medical decisions for you if you're unable to communicate your wishes. This includes decisions about treatments, surgeries, medications, and end-of-life care. Different states call this different things — Healthcare Proxy, Advance Directive, Health Care Surrogate Designation, or Patient Advocate Designation.

Financial Power of Attorney

Gives your agent authority over your financial affairs — bank accounts, real estate, investments, tax filings, and bill payments. You choose exactly which powers to grant. Most people select this when planning for potential incapacity or when they need someone to handle their affairs while traveling or deployed.

Limited / Special Power of Attorney

A limited Power of Attorney grants authority for a specific purpose or time period only. For example, authorizing someone to sell a specific property, sign a specific contract, or handle your affairs during a 3-month trip. Once the task is done or the time expires, the Power of Attorney automatically ends. Note: Florida prohibits "springing" Powers of Attorney that take effect only when you become incapacitated.
